Terms of Service

Effective date: April 7, 2026  —  RE Photo Tours is a d/b/a of Kerdos Media & Marketing, LLC, a New Jersey limited liability company (“we,” “us,” or “our”), which operates rephototours.com.

1. Acceptance of Terms

By accessing or using the rephototours.com platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including RE Photo Tours staff and clients who access delivery pages.

2. Description of the Service

RE Photo Tours provides a secure delivery platform for professional real estate photography services. The Service enables staff to manage photography jobs and enables clients to access delivered photos, videos, floor plans, and virtual tours associated with their property. The Service also integrates with QuickBooks Online for invoicing and payment processing.

3. Permitted Use

The Service is provided solely for the business purposes of RE Photo Tours and its clients. You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service for any purpose other than receiving or managing legitimate photography deliveries.
• Attempt to gain unauthorized access to any portion of the Service or any related systems.
• Reverse engineer, copy, or distribute any portion of the Service or its content.
• Use automated tools to scrape, extract, or harvest data from the Service.
• Transmit any malicious code, viruses, or disruptive content through the Service.

4. Staff Accounts and Access

Certain areas of the Service require authentication and are restricted to authorized RE Photo Tours staff. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at info@rephototours.com if you believe your account has been compromised. We reserve the right to suspend or terminate staff accounts at any time.

5. QuickBooks Online Integration

The Service integrates with QuickBooks Online (“QBO”) through the Intuit OAuth 2.0 authorization protocol. By authorizing this integration, you grant RE Photo Tours permission to create and manage invoices and customer records in your QuickBooks account as described in our Privacy Policy. You may revoke this authorization at any time through the platform settings or through your Intuit account at accounts.intuit.com. RE Photo Tours is not affiliated with or endorsed by Intuit Inc. Your use of QuickBooks Online is subject to Intuit’s own Terms of Service.

6. Intellectual Property

Photographs, videos, floor plans, and other media delivered through the Service are the property of RE Photo Tours and the client, subject to any applicable licensing agreements established at the time of booking. You may not reproduce, redistribute, or resell delivered media beyond the terms of your service agreement with RE Photo Tours.

The Service itself, including its source code, design, and all underlying software, is the exclusive property of RE Photo Tours. Nothing in these Terms grants you any license or right to use our intellectual property other than to access the Service as described herein.

7. Delivery of Services

RE Photo Tours will make reasonable efforts to deliver photography assets through the Service in a timely manner. Delivery links are provided via email and through the delivery pages on this platform. RE Photo Tours is not liable for delays caused by circumstances outside its control, including but not limited to weather, access restrictions at the property, or third-party service outages.

8. Payment and Invoicing

Photography services are invoiced and billed as agreed at the time of booking. Payment is accepted through QuickBooks Online and PayPal. Outstanding invoices that remain unpaid may result in withholding of delivered assets. RE Photo Tours reserves the right to modify pricing at any time, with changes applying to future bookings only.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Kerdos Media & Marketing, LLC (d/b/a RE Photo Tours) and its members, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid RE Photo Tours for the photography services at issue.

11. Indemnification

You agree to indemnify and hold harmless Kerdos Media & Marketing, LLC (d/b/a RE Photo Tours) and its members, employees, agents, and contractors from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Service or your violation of these Terms.

12. Third-Party Services

The Service integrates with third-party providers including QuickBooks Online, PayPal, Dropbox, Amazon Web Services, and SendGrid. RE Photo Tours is not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms of service.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to access the Service ceases immediately. Sections 6, 9, 10, 11, and 15 of these Terms survive termination.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
